Terms of Service

Welcome to Dodobird, the comprehensive virtual chat assistant designed to help users with various tasks by integrating with email, cloud storage, documents, forms, and calendars ("Service"). This Service is operated by Dodobird ("we", "us", or "our"). By accessing our Service, you agree to be bound by the following terms and conditions ("Terms of Service" or "Agreement"), all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

Acceptance of the Agreement

You must be of legal age to enter into a binding agreement in order to accept the Agreement. If you do not agree to the General Terms, do not use any of our Services. If you agree to the General Terms and do not agree to any Service Specific Terms, do not use the corresponding Service. You can accept the Agreement by actually using the Services.

User Sign up Obligations

You need to sign up for a user account by providing all required information in order to access or use the Services. You agree to: (i) provide true, accurate, current and complete information about yourself and (ii) maintain and promptly update the information provided during sign up to keep it true, accurate, current, and complete. If you provide any information that is untrue, inaccurate, outdated, or incomplete, or if Dodobird has reasonable grounds to suspect that such information is untrue, inaccurate, outdated, or incomplete, Dodobird may terminate your user account and refuse current or future use of any or all of the Services.

Service Integration and Permissions

Dodobird integrates with various third-party services including email providers (such as Gmail and Outlook), cloud storage services (like Google Drive, Dropbox, and OneDrive), calendars, and document creation tools. By using Dodobird, you authorize us to access and interact with these services on your behalf. This includes, but is not limited to:

  • Reading and sending emails
  • Creating, reading, and modifying calendar events
  • Accessing, creating, and modifying files in your cloud storage
  • Creating and managing documents and forms

You are responsible for ensuring that you have the necessary rights and permissions to grant Dodobird access to these services on your behalf. Dodobird will only access and use information from these services as necessary to provide the requested functionality within our app.

Restrictions on Use

In addition to all other terms and conditions of this Agreement, you shall not: (i) transfer the Services or otherwise make it available to any third party; (ii) provide any service based on the Services without prior written permission; (iii) use the Services to process data on behalf of any third party; (iv) reverse engineer or access the Services in order to build a competitive product or service; (v) use the Services in any manner that could damage, disable, overburden, impair or harm any server, network, computer system, resource of Dodobird; (vi) use the Services to store or transmit any content that may be infringing, libelous, threatening, or otherwise unlawful; (vii) use the Services to violate the privacy of others or to violate any applicable laws including but not limited to data protection laws.

Data Usage and Privacy

Dodobird is designed to process and manage your data from various integrated services. By using Dodobird, you acknowledge and agree that we will access, store, and process your data in order to provide our services. We are committed to maintaining the privacy and security of your data as outlined in our Privacy Policy. You are responsible for ensuring that your use of Dodobird complies with any applicable laws and regulations regarding data protection and privacy.

Third Party Applications

Dodobird Services integrate with many third party applications (hereinafter "Third Party Application(s)"). Access and use of the Third Party Applications may require acceptance of terms of service and privacy policies applicable to such Third Party Applications (hereinafter "Third Party Terms"). You are responsible for reading and understanding the Third Party Terms before accessing or using any Third Party Application. You acknowledge and agree that Dodobird is not liable for any Third Party Applications.

Fees and Payments

The Services are available under subscription plans of various durations. Payments for subscription plans can be made by Credit Card or other methods we may make available. Your subscription will be automatically renewed at the end of each subscription period unless you cancel your subscription or inform us that you do not wish to renew the subscription. At the time of automatic renewal, the subscription fee will be charged to the payment method last used by you. We provide you the option of changing the details if you would like the payment for the renewal to be made through a different payment method.

Personal Information and Privacy

Personal information you provide to Dodobird through the Service is governed by Dodobird Privacy Policy. Your election to use the Service indicates your acceptance of the terms of the Dodobird Privacy Policy. You are responsible for maintaining confidentiality of your username, password and other sensitive information. You are responsible for all activities that occur in your user account and you agree to inform us immediately of any unauthorized use of your user account by email to support@dodobirdchat.com. We are not responsible for any loss or damage to you or to any third party incurred as a result of any unauthorized access and/or use of your user account, or otherwise.

Data Ownership

We respect your right to ownership of content created or stored by you. You own the content created or stored by you. Unless specifically permitted by you, your use of the Services does not grant Dodobird the license to use, reproduce, adapt, modify, publish or distribute the content created by you or stored in your user account for Dodobird's commercial, marketing or any similar purpose. However, you grant Dodobird permission to access, copy, distribute, store, transmit, reformat, publicly display and publicly perform the content of your user account solely as required for the purpose of providing the Services to you.

Disclaimer of Warranties

YOU EXPRESSLY UNDERSTAND AND AGREE THAT THE USE OF THE SERVICES IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN AS-IS-AND-AS-AVAILABLE BASIS. DODOBIRD EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. DODOBIRD MAKES NO WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE. USE OF ANY MATERIAL DOWNLOADED OR OBTAINED THROUGH THE USE OF THE SERVICES SHALL BE AT YOUR OWN DISCRETION AND RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM, MOBILE TELEPHONE, WIRELESS DEVICE OR DATA THAT RESULTS FROM THE USE OF THE SERVICES OR THE DOWNLOAD OF ANY SUCH MATERIAL. NO ADVICE OR INFORMATION, WHETHER WRITTEN OR ORAL, OBTAINED BY YOU FROM DODOBIRD, ITS EMPLOYEES OR REPRESENTATIVES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE AGREEMENT.

Limitation of Liability

YOU AGREE THAT DODOBIRD SHALL, IN NO EVENT, BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, PUNITIVE, OR OTHER LOSS OR DAMAGE WHATSOEVER OR FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, COMPUTER FAILURE, LOSS OF BUSINESS INFORMATION, OR OTHER LOSS ARISING OUT OF OR CAUSED BY YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF DODOBIRD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. IN NO EVENT SHALL DODOBIRD'S ENTIRE LIABILITY TO YOU IN RESPECT OF ANY SERVICE, WHETHER DIRECT OR INDIRECT, EXCEED THE FEES PAID BY YOU FOR USING THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE FIRST EVENT OR OCCURRENCE GIVING RISE TO SUCH LIABILITY.

Indemnification

You agree to indemnify and hold harmless Dodobird, its affiliates, officers, directors, employees, consultants, licensors, agents, and representatives from any and all claims, losses, damages, and/or costs (including reasonable attorneys' fees and costs) arising from your use of our Services, your violation of these Terms of Service, or your infringement, or infringement by any other user of your account, of any intellectual property or other right of any person or entity. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the Service. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Governing Law

These Terms shall be governed and construed in accordance with the laws of California, USA, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Changes to Terms of Service

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
